Kim Berry, webmaster of http://www.familyinjustice.com/h1b/ proved that
perseverance can pay off. He managed to get a letter of warning to
engineering students at the State Hornet - a newspaper run by the
University of California at Sacramento.

Universities are loath to print anything critical of H-1B and at first
the Hornet was no exception. Two weeks after submitting the story Kim
noticed that nothing was happening so he called the editor to see what
the problem was. The editor said, "The submission made some strong
claims that seemed potentially libelous and that we could not verify."
Most people would give up at this point but Kim assured the editor that
his letter was accurate and then offered to provide references. Kim
added four pages of references and resubmitted.

The editor of the Hornet had an open mind when presented with the
facts, and allowed the letter to be published.

When I graduated from CSUS with a computer science degree in 1990 I
envisioned a stable, upwardly mobile career path. I did not anticipate
that Congress would sabotage our careers by flooding the job market
with foreign programmers and engineers on L-1 and H-1B visas. Over the
past three years alone the U.S. Department of Labor (DOL) has certified
over 500,000 of these visas,throwing an equivalent number of Americans
out of work.
Many believe that employers must first attempt to hire U.S. workers
before hiring foreign workers. But this is false.Last year, while
slashing 4700 jobs, Intel applied for over 8000 labor certifications
(LCA) to hire foreign engineers on H-1B visas - including 60 software
engineers at Folsom. The DOL, which is charged with protecting U.S.
workers, approved them all. Now Intel is cutting over 100 U.S. IT
workers in Folsom while ramping up in India.

Many employers use these visas to blatantly displace U.S. workers. Both
Siemens and Bank of America recently forced their U.S. workers to train
their foreign replacements before being terminated. A "lack of skilled
U.S. workers" does not explain these acts. Yet Congress made this
legal, and to date has not remedied this abuse.

U.S. tech jobs are rapidly being outsourced to foreign consulting
firms. The DOL grants unlimited L-1 visas, allowing foreign tech
workers to work in the U.S. while earning third world wages. The DOL
also grants thousands of H-1B LCAs, often for wages under $30,000 per
year. Some employers, such as Tata Services of India, insist on and
enforce an employment agreement whereby if the employee quits they owe
Tata $10,000 or more for "training." Tata forces workers to work seven
days a week, up to 14 hours per day.The DOL and Congress are condoning
indentured servitude here in the U.S., failing to protect the liberty
and property interests that U.S. workers have in their careers.
