The H-1B visa is the center of a new debate - this time in Hispanic
communities from Florida to Argentina. The controversy began when an
Argentine pin-up girl that goes by the name Dorismar was arrested at her
Florida home on Jan. 5 for violating our immigration laws because she was
here illegally. Surprisingly Dorismar was swiftly deported back to Buenos
Aires. This swift action by our immigration agents is unusual because so
few illegal aliens are ever deported, and yet it took just 8 hours to
process her deportation.
Dorismar is not happy about being deported, although she doesn't deny her
status as an illegal alien. It's not clear why the immigration service
targeted her, but some suspect it was because another voluptuous Latina
model betrayed her.
In an attempt to come back to the U.S. Dorismar hired Michael Feldendrais,
an immigration attorney. Feldendrais is petitioning to obtain an H-1B visa
for Dorismar by using Section 20 CFR 655.700 Subpart H of the regulations
which allows H-1B visas for fashion models of "distinguished merit and
ability".
Feldendrais argues that his client has extraordinary abilities who, "shows
what men like to see in magazines like "Playboy". He cited Dorismar's
career highlights such as her inclusion in Mira magazine's list of the Top
25 'Rears' in the entertainment business.

assets are rubbed out. If you want to check out more pictures and video
clips of Dorismar to verify whether she is really qualified for an H-1B
visa, you will have no trouble finding her on all the major search engines.
You can find some interesting results using Google. By searching for
"Dorismar" and "H-1B" you will see that most of the pages are in Spanish.
Hispanics seem to have a newfound interest in H-1B visa issues since this
controversy heated up. Dorismar -- aka Dora Noemi Kerchen entertained
during John Kerry's Democratic National Convention in 2004 but Google
searches turned up negative when I searched "Democratic National
Convention" and "Dorismar" and variations of her real name. I would think
the Democrats would be so proud that she performed for them that it would
be much easier to search their web pages for her name. They could increase
their web traffic by having her picture on the front page.
The absence of search results for the 2004 Convention intrigued me, so I
did an advanced Google search on Dorismar and the URL
http://www.2004dnc.com/ and yet I didn't get any results.
JUST A THOUGHT -- Perhaps a good question to ask Sen. Kerry would be how he
felt about Dorismar getting an H-1B visa.
The most important part of the interview on MSNBC, besides the shots of
Dorismar's assets, was the following statement by Tucker Carlson:
CARLSON: Why should we flood the market with cheap foreign
imports, thereby forcing our own porn actresses out of work
and oppressing their wages?
Could it be that Tucker Carlson is one of the few television commentators
who understands that H-1B floods labor markets thereby lowering wages, or
is he just overly sympathetic to the plight of porn stars?

Heres a believe it or not story. Talented foreigners around the world
are flashing their skills to get into this country, of course. But very
few have the assets of Argentine bombshell Dorismar. The former "Playboy"
playmate was rounded up by immigration authorities and deported with her
husband on January 5 after living illegally in Miami for five years.
Now her attorney is trying to get the calendar pinup back into this country
by classifying her as, quote, "an alien of extraordinary ability."
Tucker Carlson was joined by Dorismars attorney, Michael Feldenkrais, to
discuss this quest for special immigration status.

TUCKER CARLSON, HOST 'THE SITUATION': What exactly is Dorismars
extraordinary ability?
MICHAEL FELDENKRAIS, DORISMARS ATTORNEY: Well, the INS has already
considered her as an extraordinary ability, and thats probably her
looks, her singing abilities, and her looks, I guess.
CARLSON: You cant see the screen, but we unfortunately have -- weve
blotted out her extraordinary ability that youre talking about. And
thats her rear end, of course. She was named by "Mirror" magazine as a
woman who possessed one of the top 25 rear ends in all of entertainment.
Youre saying that because this girl has a cute butt, she should be a
U.S. citizen?
FELDENKRAIS: Well, not necessarily U.S. citizen. But she should be
allowed to be able to work in this country. She should be allowed to come
in and do her performances, do whatever it is that she needs to do to
proceed with her continued dream of becoming a, quote unquote, supermodel
and so on and so forth. Absolutely. She should have the right to work,
come in, maybe even leave, go in and out of the country. Absolutely.
CARLSON: So that -- you think that thats a valid criterion for entry
into the country, having an extraordinary body, having a cute butt.
Thats sort of -- you know, all the girls with the dumpy butts dont
get in. But the ones with the cute ones do.
FELDENKRAIS: In reality its not a matter of her having a cute butt and
somebody having a bad butt. But the reality is there is a classification
for people who have risen to the level where she has in the scenario of...
CARLSON: Risen to the level. She stars in "Latinas gone Crazy." Now, no
offense. I havent actually seen the video. But I mean, its not like
-- I mean, shes not Barbra Streisand. You know what I mean? "Latinas
Gone Crazy." Do we need more "Latinas Gone Crazy" actresses in this
nation, truly?
FELDENKRAIS: Well, I dont know if we need them or we dont need them.
But the reality is that she is -- thats her job. That is our job like
my job is to be an attorney. Your job is to be -- and each one of us has
our own abilities. Her ability is to become a model that shows what men
like to see in magazines like "Playboy" and so on.
CARLSON: Do you think -- is there a porn shortage in this country, do you
think? I mean, is there a lack of homegrown porn actresses? Is this a
crisis?
FELDENKRAIS: I do not believe its a crisis. Theres definitely a lot
of talent out there. And but that doesnt stop us from...
CARLSON: Why should we flood the market with cheap foreign imports,
thereby forcing our own porn actresses out of work and oppressing their
wages?
FELDENKRAIS: I dont think were flooding them. I think one person,
two people. This is not an area where youre going to have 200 million
people coming in as porn actresses. But you will have a select few, a very
good few, that will be able to do what she does. And youre not
necessarily letting the floodgates and allowing half a million people come
in just because they have a cute butt. No.
CARLSON: Let me just stop you, because were out of time. But also just
to stand back in awe of you, Michael Feldenkrais. If I am ever in trouble
in the state of Florida, Im going to hire you.
You have cracked not a single smile. You are arguing with a straight face
that your client ought to be allowed into the United States because she has
a good body? Youre unbelievable. Youre a lawyers lawyer, and I
appreciate your coming on our show. Thank you.
FELDENKRAIS: Thank you for having me.

PINUP GIRL WANTS BACK INTO U.S.
An Argentine bombshell is hoping to come back to the United States after
her abrupt deportation earlier this month.

Dorismar -- aka Dora Noemi Kerchen -- has been many things: Playboy
Playmate, calendar pinup, performer at a Democratic National Convention
party and purveyor of sophisticated soft-core videos inspired by Girls Gone
Wild.
Now, she qualifies as an ''Alien of Extraordinary Ability'' -- but that
legal designation may not be enough to get her back into the United States.
The 29-year-old Argentine sexpot -- blessed with copious curves and a
seemingly boundless capacity to promote them -- was deported with her
husband/manager Alejandro Schiff on Jan. 5, after five years in Miami as an
illegal immigrant and Hispanic media star. Rumors flew in the
Spanish-language talk circuit that her rival Sissi, a similarly voluptuous
Latina model, betrayed her to immigration authorities after Dorismar landed
Sissi's former calendar client. Sissi, whose real name is Isabel Fleitas,
has denied it.
The supposed tiff between Dorismar and Sissi is a footnote in the saga that
thousands of immigrants across the country are facing post-Sept. 11. The
government has stepped up enforcement of immigration rules, making it more
likely that foreign tourists who overstay their visits will face dire
consequences.
Dorismar came under a special program, which ended for Argentines in 2002,
that allowed tourists from certain countries to enter with only a passport
-- no visa -- and stay 90 days.
Many stayed longer, banking on lax enforcement of tough penalties. Those
who stay even one day over are subject to immediate deportation without
recourse and generally barred from the United States for 10 years,
according to Barbara Gonzalez, a U.S. Immigration and Customs Enforcement
spokeswoman.
All hope is not lost for Dorismar, though. Before her banishment, her
lawyer successfully petitioned immigration authorities to qualify her as an
alien of extraordinary ability, citing career highlights such as her
inclusion in Mira magazine's list of the Top 25 ''Rears'' in the
entertainment business.
As a result, she can apply for a waiver of the 10-year-ban at the consular
offices in Buenos Aires.
''I have a lot of faith, and I'm praying every day that I will be able to
return,'' she said from Buenos Aires. ``God is great, and I'm never going
to abandon my dreams.''
Already a celebrity in her native Argentina, Dorismar quickly cracked
Hispanic television when she arrived here. For one year she hosted a music
show, and went on to appear regularly on Univisisn's El Gordo y La Flaca,
where she alternately played the roles of scantily clad maid, naughty nurse
and others.
In March 2003, she was on the cover of Playboy, and she performed at the
Democratic National Convention in 2004.
In 2004, the Panamanian singer Edgardo Franco, also known as ''El
General,'' sponsored her ''extraordinary ability'' petition. It is a
special employment designation given to those who are considered to have
risen to the top of their field.
As her lawyer, Michael Feldenkrais, works toward gaining a pardon, Dorismar
continues her career.
One of her latest ventures is as the first headliner in a new line of
sensual videos called Latinas Gone Crazy.
''Girls Gone Wild is just a bunch of drunk college girls, and we wanted to
provide more than that,'' said Roly Rodriguez, who co-owns the venture with
Miami rapper Pitbull, aka Armando Pirez. ``Dorismar has always had a
reputation in the past of being a bit racy, and she loved the idea.''
Dorismar's Private Party was released last month, and the plot goes like
this: Thirty sexy Latinas party in a mansion and most of the women end up
nearly nude. Not wanting to ''taint her reputation,'' Rodriguez said he
limited Dorismar's performance to a solo bubble bath scene.
Also recently, a conglomerate of trucking companies -- South Kearny Truck
Repair, Florida Truck Repair Center and CPQ Freight System -- contacted
Dorismar about being the exclusive face for the company, including
appearing in their 2007 calendar. Sissi did the 2006 calendar, and the
conglomerate is currently suing her because of problems with the calendar's
production, said Paulina Fatima, the conglomerate's creative director.
The switch from Sissi to Dorismar sparked the rumors that Sissi had ratted
her out.
In a prepared statement read on Spanish-language television, Sissi denied
the allegations.
''As an immigrant in the United States, as a Latina, as a Cuban, I am
extremely hurt and offended at the source that gave birth to this vile
lie,'' she said.
Dorismar and her husband won't discuss whether they believe Sissi was
involved in their abrupt ejection.
''I don't want to think that someone could try to do such damage to
another,'' Dorismar said.
Dorismar was getting ready to sign the trucking company modeling contract
on Jan. 5 when she heard pounding on the door of her peach town house in
Doral. She jumped out of the shower and ran downstairs, only to find her
husband and one of his friends handcuffed and surrounded by immigration
officers.
Eight hours later, she and her husband were on a plane to Buenos Aires.
''The way I understood it, they don't come to your door and take you away
unless you're a criminal or you've done something terrible,'' she said.
``If having a dream and working to follow it are a crime, then I'm guilty
and I ask forgiveness. I am asking for forgiveness.''

Argentine model and actress Dorismar fights to return to the U.S.

MIAMI, FL -- Immigration attorney Michael Feldenkrais, a partner with the
Miami law firm of Adorno & Yoss, is filing for a waiver to request the
United States Government to pardon and return the Argentine-born model,
actress and singer Dorismar to the United States.
"Dorismar is safely in Buenos Aires anxiously awaiting her return to
Miami," said Mr. Feldenkrais. "She deeply misses Miami, her friends and
colleagues, and is saddened by the events of the last few days. She is,
however, optimistic that the situation will be resolved in a timely manner
and appreciates all of the support she has received so far from her beloved
fans."
Feldenkrais is the Chair of the firm's Immigration practice group where he
focuses in the area of Immigration Law. Experienced in the preparation of
legal documentations required for all types of visas including
Non-Immigrant and Immigrant Visas, Feldenkrais has been successful in
securing hundreds of visa requests for corporations, and professionals.
Born Dora Noemi Kerchen, the famous model, Hispanic television personality
and former Playmate is a popular Hispanic figure and well known for her
imaginative calendars. She has been living in the U.S. since December 31,
2000.
According to Feldenkrais, Dorismar entered the U.S. as part of a Visa
Waiver Pilot Program from Argentina which allows for a three month maximum
length of stay.
Subsequent to that, because of Dorismar's high standing in the community,
Feldenkrais was successful in petitioning for an "Alien of Extraordinary
Ability" which would allow Dorismar to seek permanent residence status.
Dorismar's immigration sponsor was Panama's El General, Edgardo Franco, the
musician widely acclaimed as the granddaddy of the "reggaeton" genre.
Dorismar was deported on January 5, 2006.
According to Feldenkrais, because Dorismar is such a public figure, he
hopes that the waiver which is being applied for will be granted. A
groundswell of support has already started in the Hispanic community for
Dorismar. The Univision website has received, in one week, close to 4,000
hits with the news of her deportation from the U.S. to Argentina.
An email and letter writing campaign of support has already been
established. Those interested in helping Dorismar should visit
www.dorismar.net.
To support Dorismar, a conglomerate of companies (South Kearny Truck Repair
Center, Inc.; Florida Truck Repair Center, Inc. and CPQ Freight System,
Inc.) who launched the 2006 calendar for Sisi, headed by Paulina Fatima,
have begun the paperwork for the petition to the U.S. Citizen and
Immigration Services, using her as the exclusive image of the companies.
This petition will accompany the waiver sought to pardon her and have her
returned to the United States.
