The job advertisement below is on Dice.com. AR Systems was very explicit
that only H-1Bs need to apply.
I went to their website and found that half of it doesn't work. What does
this say about who they are hiring?
They appear to be fishing for resumes because the skills that are being
asked for are quite generic. Programmers that know Visual Basic with a
"positive attitude" and business analysts that "have exceptional
communication skills" can be found at any local community college.
*** PLEASE, READ THIS BEFORE ASKING ME QUESTIONS! ***
Every time I do a newsletter with a dubious job ad I get a lot of questions
about what can be done to stop these companies from discriminating against
American workers. Unfortunately there isn't a satisfactory answer because
these job ads don't constitute discrimination against protected classes
such as gender, race, or age. Denying employment opportunities to U.S.
citizens is usually classified as a "national origin" issue which is not
treated the same way as discrimination against protected classes. The
exception to this is if a foreign national claims that U.S. employers are
discriminating against him or her because of national origin. Whether by
intent or by accident, our laws protect foreign workers - not Americans.
The implied intent of H-1B is to allow employers to only look for foreign
workers if an American cannot be found, but the actual regulations don't
require them to do so. This is an issue of the "letter of the law" versus
the "spirit of the law". Employers will continue this type of
discrimination as long as they have a supply of cheap foreign labor that is
willing to underbid Americans with laws that are favorable towards this
type of behavior.
Complaints can be filed to various government agencies about the wording of
the ads. Although endeavors like this are more symbolic than substantive it
is probably a worthwhile endeavor. Civil rights groups in the past
recognized that allowing employers to use discriminatory language in job
ads legitimizes their actions, so it follows that one of the steps
necessary to eliminate discrimination is to forbid these types of ads.

You can find many more newsletters about dubious job ads just by searching
the archive page for newsletters that contain "job ad" in the subject
header. I use that keyword in the title anytime I feature these ads.

I didn't provide the phone number or email for this job ad for a reason.
That's because you should cool off and think before you start flaming the
person who wrote the job ad. Nasty phone calls and emails will do nothing
to correct problems like this, and you might undermine the efforts of
activists who are filing complaints. Get mad, get angry, but don't be
foolish!
